Adaptable Resolution Process

Intake & Assessment*
  1. Adaptable Resolution is voluntary and may be requested by either party. When a party expresses interest in Adaptable Resolution:
    1. Adaptable Resolution Intake: Equity Office staff will meet with the individual interested in initiating the process.
    2. The party requests Adaptable Resolution by signing the election form.
    3. The Equity Office will assess if the process is appropriate.**
    4. Notice of Adaptable Resolution will be sent to each party.
    5. The other party will be offered an intake to learn their options.
  2. To commence the Adaptable Resolution process:
    1. Each party must provide their voluntary written consent by signing the election form. Either party may withdraw from the process anytime prior to signing a resolution agreement.
    2. The Equity Office will assess if the process is appropriate.**
Adaptable Resolution Process*
  1. Facilitators meet separately with each party to determine their approach to the process. Parties may select from the following options:
    1. Restorative Justice Conference or Circle: focus on understanding and taking responsibility for harm
    2. Facilitated Direct Conversation: structured face-to-face conversation between the parties with the support of facilitators
    3. Mediation: focus only on logistical outcomes; does not require perspective sharing or taking responsibility for harm
    4. Shuttle Communication: structured conversation through facilitators; does not require direct communication between parties
Resolution Agreement*
  1. Parties sign a resolution agreement to resolve the process:
    1. The terms are tailored to the parties’ specific needs and requests. Potential terms may include but are not limited to: education or training, taking responsibility for harm caused, interaction agreements, restrictions on participation in the University’s programs or activities or attendance at specific events, etc.
  2. Once signed by each party and approved by the Equity Office:
    1. the Adaptable Resolution agreement is binding, and breaking it would result in disciplinary action
    2. neither party may initiate an Equity Office investigation for the same allegations.

* An Advisor of Choice may accompany, support, and advise each party throughout the Adaptable process. A report to law enforcement may be made at any point throughout this process. Resources and support are available throughout this process.

** Initial assessment is conducted and may re-occur at any time new information is brought forward.
